The U.S. Supreme Court has allowed a lower-court injunction against a new U.S. Postal Service mail-in voting rule to remain in effect for the 2026 election. New York Attorney General Letitia James and a multistate coalition challenged the policy in August, arguing that it could interfere with states’ election procedures and prevent otherwise eligible voters from successfully receiving or returning ballots. A federal court initially halted the rule and later issued a preliminary injunction while the lawsuit proceeds. The Supreme Court declined to stay that injunction, meaning the disputed USPS requirements will remain blocked through the November election as the underlying legal challenge continues. James characterized the decision as a protection for voters and urged eligible Americans to participate in the election.
Attorney General James Secures Supreme Court Victory Protecting Mail-In Voting
NEW YORK – New York Attorney General Letitia James today released the following statement after the U.S. Supreme Court left a lower court’s order in place blocking the U.S. Postal Service’s (USPS) new mail-in voting rule:
“Today, the Supreme Court protected one of our most fundamental, inalienable rights – the right to make your voice heard at the ballot box. This last-minute change could have thrown our elections into chaos, and I am truly relieved the Court granted this reprieve.
“Voters should never have to wonder whether a ballot they legally cast will be counted because the federal government suddenly changed the rules. We will keep fighting to make sure every eligible ballot is counted come November.
“Now, I encourage all eligible Americans to get out and vote – and vote early.”
